Rights and responsibilities of the applicants
The Applicant has the right to the following:
- impartial and competent conformity assessment (certification);
- free access to the information on the conformity assessment process;
- guarantee of confidentiality of information provided;
- efficient and timely processing of complaints and requests;
- information on changes of certification requirements.
The Applicant shall guarantee the following:
- fulfillment of applicable requirements to the conformity assessment objects which undergone certification, as well as the requirements to carrying out of the certification work;
- taking the necessary measures to control the fulfillment of applicable requirements to the conformity assessment objects and processing of complaints;
- provision of copies of certification documents in accordance with the requirements of the corresponding certification schemes for the purpose of conformity assessment process;
- fulfillment of applicable requirements, requirements of the certification body or the certification schemes regarding the use of conformity marks (to affix the conformity mark on the products which meet the requirements of normative documents and which are covered by the certificate), and regarding the reference to the products certification in the mass media;
- registration of complaints brought down to the Applicant relative to the conformity assessment process and concerning the fulfillment of requirements to the conformity assessment objects, including those defined by the certification schemes, and providing them to the certification body on request;
- taking corresponding measures as regard to the complaints and any drawbacks revealed in the conformity assessment objects, which affect the conformity of these objects with the requirements , including those defined by the certification schemes; recording of the measures taken;
- informing the CBs on the changes made to the technical documentation relating to the explosion protection means or safe use, which can affect the fulfillment of requirements to the conformity assessment objects, including those defined by the certification schemes;
- providing the samples of duly identified products;
- if the product non-compliance with the requirements of normative documents is revealed, to take measures preventing from selling these products;
- preventing from using in a misleading way of any certificate of conformity, declaration of conformity or test report or any part thereof;
- payment of all costs relative to the certification and periodical surveillance audits of the production facilities of the approved products during the period of validity of the certificate;
- to not use the certification of products in a way to harm image of NANIO CCVE , and to not make any declarations relative to the certification of the products which can be considered as unallowable and misleading;
- in case of suspension or cancellation of certification, to not make reference to the certification for promotion purposes and return to the CB CCVE all certification documents.
